1. Acceptance of Terms
By accessing, browsing, or using the Site — including by submitting a prescription transfer request, refill request, or contact form — you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, please do not use the Site.
If you are using the Site on behalf of another person (for example, a family member or someone for whom you are a caregiver or legal representative), you represent that you are authorized to do so and to accept these Terms on their behalf.
2. Eligibility
The Site is intended for use by individuals who are at least 18 years of age and located in the United States. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian. We do not knowingly collect information from children under 13.
3. No Medical Advice; No Professional Relationship
The content on this Site — including service descriptions, health information, and answers to frequently asked questions — is provided for general informational purposes only. It is not medical, pharmaceutical, diagnostic, or treatment advice, and it is not a substitute for consultation with a licensed physician, pharmacist, or other qualified healthcare professional.
Nothing on this Site creates a pharmacist-patient or provider-patient relationship. Submitting a form, sending an email, or reading content on the Site does not, by itself, establish such a relationship.
Never disregard professional medical advice or delay seeking it because of something you read on this Site.
If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use this Site to communicate a medical emergency.
4. Prescription Services, Transfers, and Refills
Requests submitted through the Site — including prescription transfer requests, refill requests, and consultation inquiries — are requests only. They are not confirmed orders and are not filled automatically.
You acknowledge and agree that:
• All requests are subject to verification of your identity, your prescription, and your insurance coverage.
• All requests are subject to the professional judgment of a licensed pharmacist, who may decline to fill or transfer a prescription consistent with applicable law and professional standards.
• Fulfillment depends on medication availability, the timely response of your prior pharmacy, prescriber authorization, and applicable federal and New York State law. Certain medications, including many controlled substances, cannot be transferred between pharmacies or may be subject to additional restrictions.
• Estimated timeframes described on the Site are estimates only and are not guarantees.
• Delivery services are offered within our stated service area and are subject to availability. Delivery timeframes are estimates and may be affected by weather, traffic, staffing, or circumstances outside our control.
We are not responsible for delays, errors, or non-fulfillment caused by inaccurate or incomplete information you provide, by your prior pharmacy, by your prescriber, or by your insurance plan.
Do not use the Site to request urgent or time-critical medication. If you need a medication urgently, call us at (718) 717-1417 or speak with a pharmacist in person.
5. Information You Submit
You agree to provide accurate, current, and complete information when using any form on the Site, and to promptly update that information if it changes. Submitting false or misleading information may result in a request being declined.
Web forms and unencrypted email are not fully secure methods of transmitting sensitive health information. Please limit what you submit through the Site to the information specifically requested (for example: name, date of birth, contact information, current pharmacy, and medication names). Do not send diagnoses, clinical histories, insurance card images, financial account numbers, or other sensitive details through the Site’s forms or by email. To discuss sensitive matters, call us or speak with a pharmacist directly.
Our handling of the information you provide is described in our Privacy Policy. Protected health information created or received by Guardian Apothecary in the course of providing pharmacy services is also governed by our Notice of Privacy Practices and by applicable law, including HIPAA.
6. Acceptable Use
When using the Site, you agree not to:
• Use the Site for any unlawful purpose or in violation of any applicable federal, state, or local law;
• Submit a prescription request on behalf of another person without their authorization;
• Attempt to obtain medication by fraud, misrepresentation, forgery, or deception;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Site, its servers, or any connected systems;
• Introduce viruses, malware, or other harmful code;
• Use automated means (bots, scrapers, crawlers) to access, collect, or harvest data from the Site without our prior written permission;
• Copy, reproduce, republish, or redistribute Site content except as permitted in Section 7;
• Use the Site in any manner that could damage, disable, overburden, or impair it, or interfere with any other party’s use of it.
We reserve the right to refuse service, restrict access, or remove content at our discretion.
7. Intellectual Property
All content on the Site — including text, graphics, logos, photographs, icons, page layouts, and the “Guardian Apothecary” name and marks — is owned by Guardian Apothecary or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.
You may view, download, and print Site content for your own personal, non-commercial use. Any other use — including reproduction, modification, distribution, public display, or commercial exploitation — requires our prior written consent.
8. Third-Party Links and Services
The Site may contain links to third-party websites, tools, or services (for example, mapping services, social media platforms, or online refill platforms). These links are provided for convenience only. We do not control, endorse, or assume responsibility for the content, privacy practices, accuracy, or availability of any third-party site or service. Your use of a third-party site is at your own risk and subject to that party’s terms and privacy policy.
9. Testimonials and Reviews
Patient testimonials that appear on the Site reflect the individual experiences of the people who provided them. They are shared with permission and are not a promise, guarantee, or prediction of the results any other patient will experience. Individual results vary.
10. Site Availability and Changes
We work to keep the Site available and accurate, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Site — including services, features, or content — at any time and without notice. Information on the Site, including pricing, hours, service offerings, and delivery areas, is subject to change.
11. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GUARDIAN APOTHECARY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the Site will be secure, error-free, uninterrupted, or free of viruses or other harmful components, or that any defects will be corrected.
This section applies to your use of the Site. It does not limit or disclaim any duty of care Guardian Apothecary owes you as a licensed pharmacy in connection with pharmacy services actually provided to you, and nothing in these Terms is intended to disclaim liability that cannot lawfully be disclaimed.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GUARDIAN APOTHECARY AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE — INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION — WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms limits liability for personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Guardian Apothecary and its owners, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your misuse of the Site; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) false, inaccurate, or unauthorized information you submit through the Site.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Queens County, New York, and you consent to the personal jurisdiction of those courts.
15. Severability and Waiver
If any provision of these Terms is found to be unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.
16. Entire Agreement
These Terms, together with our Privacy Policy, Accessibility Statement, and Notice of Privacy Practices, constitute the entire agreement between you and Guardian Apothecary regarding your use of the Site, and supersede any prior agreements or understandings on that subject.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
